TheBrainStak provides AI-powered tools and resources for developers, including workflow guidance, prompt systems, code assistance concepts, automation templates, knowledge-base workflows, and related consulting or digital products.
3. Accounts
You are responsible for maintaining accurate account information, safeguarding login credentials, and all activity that occurs under your account. You must notify us promptly of unauthorized use or suspected security issues.
4. Payments, Billing, and Taxes
Paid services may be offered as one-time purchases, subscriptions, custom plans, or usage-based services. You authorize us and our payment processor to charge your selected payment method for all applicable fees, taxes, and renewal charges.

If a payment dispute is opened through a card issuer or payment provider, we may provide relevant records such as order details, login activity, delivery confirmations, support communications, and refund history to respond to the dispute.
9. Acceptable Use
You may not use TheBrainStak to violate law, infringe rights, attack systems, distribute malware, generate deceptive content, reverse engineer protected parts of the service, overload infrastructure, resell access without permission, or submit confidential data you are not authorized to share.
10. AI Output
AI-generated output may be inaccurate, incomplete, or unsuitable for your specific use. You are responsible for reviewing, testing, and validating code, prompts, recommendations, and other outputs before relying on them in production or business decisions.
11. Intellectual Property
TheBrainStak, including its branding, website content, templates, product design, workflows, and documentation, is owned by us or our licensors. Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable right to use the services for your internal development or business purposes.
12. Customer Content
You retain rights to content you submit. You grant us a limited license to host, process, transmit, and display that content only as needed to provide, secure, support, and improve the services, subject to your plan and applicable agreements.

TheBrainStak may integrate with payment processors, analytics providers, AI model providers, hosting services, communication tools, and other third parties. Their services are governed by their own terms and policies, and we are not responsible for third-party products outside our control.
14. Disclaimers
The services are provided "as is" and "as available." To the maximum extent permitted by law, we disclaim warranties of merchantability, fitness for a particular purpose, non-infringement, uninterrupted availability, and error-free operation.
15. Limitation of Liability
To the maximum extent permitted by law, TheBrainStak will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost data, or business interruption. Our total liability for any claim will not exceed the amount you paid to us for the service giving rise to the claim in the 3 months before the event.
16. Termination
We may suspend or terminate access if you violate these Terms, fail to pay, create security risk, misuse the services, or if continued access may expose us or others to legal or operational risk. You may stop using the services at any time.
17. Governing Law
Unless a separate agreement states otherwise, these Terms are governed by the laws applicable in the jurisdiction where TheBrainStak is legally registered, without regard to conflict-of-law rules.
